Who is liable for a dog bite at the vet in NJ?

On Behalf of | Sep 22, 2025 | Animal Bites & Attacks

When a dog bite occurs during an already stressful vet visit, it creates confusion and raises an important question: Who is responsible?

New Jersey law provides a clear starting point but also has important exceptions for these unique situations.

The general rule vs. the professional exception

New Jersey’s dog-bite statute makes owners strictly liable when their dog bites someone in a public place or on private property where the person is lawfully present. In most cases, this means you are responsible if your dog bites, regardless of the animal’s history.

Veterinary clinics, however, are treated differently. Courts apply the “veterinarian’s rule,” which recognizes that vets and their staff assume certain risks as part of their work. Since they are trained to handle animals that may act unpredictably, owners are often shielded from strict liability if a bite occurs during treatment.

When an owner is still responsible

This protection has limits. The veterinarian’s rule only covers professional staff, not other clients or their pets in the waiting room. If your dog bites another person or animal there, you remain fully responsible under the strict liability statute.

Even with professionals, the veterinarian’s rule does not excuse negligence. If you fail to warn staff about your dog’s known history of aggression, or if you act carelessly in another way that increases risk, you can still be liable. In these cases, courts may allow claims to move forward despite the rule.

Steps to protect your legal options

If an incident occurs, report it to the clinic management immediately and document everything. These details may matter when the incident leads to questions about liability.

Because these situations are complex, understanding your specific legal standing is a crucial first step. If your dog has bitten someone, consider speaking with an attorney to learn how to best move forward.
